Agently AI (a product of Affluent Marketing) takes data protection seriously. This Privacy Policy explains how we collect, use, store, share, and protect personal data. We comply with the Digital Personal Data Protection Act, 2023 (India); the General Data Protection Regulation (EU/UK); the UAE Personal Data Protection Law (PDPL); and the California Consumer Privacy Act (CCPA) where applicable.
1. Introduction
We provide an AI-powered sales workforce platform for premium clinics. Our services involve processing personal data of two main groups:
- Clinic Clients — businesses subscribing to our services;
- Patients of Clinic Clients — individuals who interact with AI agents deployed for our Clients (callers, ad lead respondents, dormant patient list members).
For Clinic Client data, we act as a Data Controller. For Patient data processed through our AI agents on behalf of Clinic Clients, we act as a Data Processor, while the Clinic Client remains the Data Controller.
2. Data We Collect
2.1 From Clinic Clients
- Business name, address, contact phone, email;
- Founder/owner name, designation, photograph (if provided);
- Billing information including payment method details (processed by our payment processor — we do not store complete card numbers);
- Communications you exchange with us (emails, support tickets, call recordings);
- Usage data on how you interact with our dashboard.
2.2 From Patients (on behalf of Clinic Clients)
- Phone number and call metadata (time, duration, source);
- Voice recordings of conversations with AI agents;
- Transcripts and AI-generated summaries of those conversations;
- Name, email, treatment interest, booking status, and other information shared during the call;
- Patient interaction history with the clinic (only data the clinic shares with us through CRM integration or upload).
2.3 Automatically Collected
- IP address, browser type, device information, operating system;
- Pages visited on agentlyai.in, time spent, referral source;
- Cookies and similar tracking technologies (see Section 11);
- Aggregated analytics on dashboard usage.
3. How We Use the Data
We use the data we collect for the following purposes:
- Service Delivery: Operating AI agents, processing calls, generating bookings, sending notifications, updating dashboards, providing customer support;
- AI Improvement (Clinic-Specific): Training our AI agents on each Clinic Client's specific treatments, scripts, and pricing to improve performance — this is done in isolated, client-specific contexts;
- Analytics & Reporting: Tracking key performance indicators, generating performance reports, calculating recovered revenue against targets;
- Communications: Sending service updates, billing notices, important policy changes, and relevant product information;
- Legal Compliance: Meeting regulatory obligations, responding to lawful requests, enforcing our Terms of Service;
- Service Improvement: Anonymized and aggregated data may be used to improve our underlying AI models and benchmarks.
4. Legal Basis for Processing
We process personal data on the following legal grounds:
- Contract: To perform our obligations under our service contract with Clinic Clients;
- Consent: Where you (or the Patient via the Clinic Client) have provided explicit consent for specific processing activities, such as call recording;
- Legitimate Interest: For service operation, security, fraud prevention, and limited service improvement, balanced against your rights;
- Legal Obligation: Where processing is necessary to comply with applicable law.
5. Patient Data — Special Protections
Patient data is sensitive. We apply additional protections:
- Clinic Client Responsibility: Clinic Clients are responsible for obtaining all necessary patient consents for call recording, data processing, and AI agent interactions, in compliance with applicable laws in their jurisdiction;
- No Marketing to Patients by Agently AI: We never use patient data for our own marketing or for cross-clinic outreach;
- Isolation Between Clients: Each Clinic Client's data is stored in logically isolated environments. Data from one Clinic Client is never used to train AI for another Clinic Client;
- Sensitive Health Data: Where conversations may touch on health information, we treat such data with elevated protections aligned to applicable health data laws;
- Data Residency Options: Clinic Clients on the Agently Dominate tier may request India-only or UAE-only data residency for additional compliance comfort.
For Clinic Clients: You are the Data Controller for your Patient data. You must inform your Patients that calls may be recorded and processed by an AI agent, and obtain their consent in accordance with applicable laws (DPDP Act in India, GDPR in EU/UK, PDPL in UAE, state-level laws in US). Agently AI provides standard disclosure scripts for AI agents to use at the start of every call.
6. Sharing of Data
We do not sell personal data. We share data only with the following categories of recipients:
6.1 Trusted Service Providers
We engage a limited number of vetted third-party service providers to enable service delivery — including voice infrastructure, cloud hosting, payment processing, calendar booking, communications platforms, and analytics. All service providers are bound by data processing agreements requiring confidentiality and security standards consistent with applicable law.
6.2 Clinic Clients (for Patient Data)
Patient data collected through AI agents is shared with the corresponding Clinic Client through dashboards, exports, and integrations, as that is the entire purpose of the service.
6.3 Legal & Regulatory
We may disclose personal data when required by law, court order, or government request, or to protect our legal rights, prevent fraud, or respond to emergency situations involving risk to life or safety.
6.4 Business Transfers
In the event of a merger, acquisition, restructuring, or sale of assets, personal data may be transferred as part of the business assets, with appropriate notice to affected individuals.
7. International Data Transfers
Agently AI is headquartered in India. Personal data may be transferred to, stored in, or processed in jurisdictions other than your own — particularly India, UAE, and the United States (for certain service providers).
Where personal data is transferred outside its country of origin, we ensure appropriate safeguards are in place, including:
- Standard Contractual Clauses for EU/UK transfers;
- Contractual data protection requirements with all service providers;
- Compliance with cross-border transfer requirements under the DPDP Act, PDPL, and other applicable laws.
8. Data Retention
We retain personal data only as long as necessary to fulfill the purposes for which it was collected, plus any additional period required by applicable law.
| Data Type | Retention Period |
| Call recordings & transcripts | 12 months from call date (or as specified in your contract) |
| Patient lead records | Duration of Clinic Client contract + 90 days post-termination |
| Clinic Client account data | Duration of contract + 7 years (tax/legal compliance) |
| Billing & payment records | 7 years from transaction (tax requirement) |
| Aggregated analytics | Indefinite (anonymized, no personal identifiers) |
| Web analytics & cookies | Up to 24 months |
Upon termination of a Clinic Client contract, all Patient data is exported to the Clinic Client and then deleted from our systems within 90 days, except where retention is required by law.
